1. Scope of Services
LaGrand GmbH provides a SaaS platform (the "Service") that enables users to access real-time data, historical datasets, and predictive forecasting models for industry, finance, and government sectors. The Service is offered on a subscription or pay-per-download basis as described on the pricing page.
2. Intellectual Property & Data Usage License
All data, forecasts, reports, and content provided through the Service ("Data") remain the intellectual property of LaGrand GmbH or its data providers.
Upon purchase or subscription, LaGrand GmbH grants you a limited, non-exclusive, non-transferable, and revocable license to use the Data solely for your internal business purposes.
- You may not resell, redistribute, sub-license, or publicly display the Data or any derivative works that reveal the raw Data.
- You may not use the Data to build a competing product or service.
- Systematic scraping or automated extraction of Data outside of provided API endpoints is prohibited.
3. Disclaimer Regarding Forecasts & Data Accuracy
The Service includes forward-looking statements and forecasts based on probabilistic models and historical trends.
No Guarantee of Results: Forecasts are estimates and actual future results may differ materially. LaGrand GmbH does not guarantee the accuracy, completeness, or timeliness of any Data or forecasts.
No Financial Advice: The Data is provided for informational purposes only and does not constitute financial, investment, or legal advice. You are solely responsible for any decisions or actions taken based on the Data.
4. User Obligations
Users must provide accurate registration data and keep their login credentials confidential. User accounts are for individual use ("single-seat") unless an enterprise license is agreed upon. Misuse of the Service, including but not limited to sharing credentials or bypassing access controls, is strictly prohibited.
5. Payment & Billing
Subscriptions and one-time purchases are billed in advance. All fees are non-refundable unless otherwise required by law. Payments are processed via our integrated third-party payment providers. Late payments may result in immediate suspension of access to the Service.
6. Limitation of Liability
To the fullest extent permitted by applicable law, LaGrand GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.
In no event shall LaGrand GmbH's total liability exceed the amount paid by you to LaGrand GmbH for the Service in the twelve (12) months preceding the claim.
7. Indemnification
You agree to indemnify and hold LaGrand GmbH harmless from any claims, damages, liabilities, and expenses arising out of your use of the Data, your violation of these Terms, or your violation of any third-party rights.
8. Termination
Either party may terminate the agreement with 30 days written notice. LaGrand GmbH reserves the right to terminate or suspend access immediately without notice for any breach of these Terms. Upon termination, you must cease all use of the Data and destroy any copies in your possession.
9. Governing Law & Jurisdiction
These Terms are governed by Swiss law. The exclusive jurisdiction for any disputes is the courts of the Canton of Thurgau.
